RA Constitution is in need of reforms
The RA Constitution is in need of serious reforms. This is what member of the RA Constitutional Court Felix Tokhyan said today.
"Armenia's Constitution doesn't function like it is supposed to function today" said Felix Tokhyan.
According to him, the judicial system and the local self-government bodies are what need constitutional reforms.
"The lack of an independent court system has a serious impact on the economy as well since those making investments in Armenia's market can't defend their rights to investments in court," mentioned Felix Tokhyan.
According to Tokhyan, time is the biggest problem.
"The world is changing at a very rapid pace, and Armenia is lagging. Our political system needs to be seriously modernized, and those problems require constitutional reforms," said the CC representative.
As Felix Tokhyan mentioned, Article 1 of Chapter 1 of the RA Constitution isn't justified. According to that Chapter, the Republic of Armenia is a sovereign, democratic, social, legal state.
"The Constitution must establish and regulate not only the relations between citizens and the state, but the status of several elements of civil society as well," said Tokhyan.
According to Felix Tokhyan, the Constitution adopted in 2005 couldn't be perfect because it was adopted in an atmosphere in which there was lack of political solidarity.
"The opposition has boycotted the Constitution that was adopted before 2005 and the one adopted in 2005. Today, when the opposition has gone from the streets to the parliament, is the most favorable time to make constitutional reforms."
