To dispute bill denial
French lawyers can dispute the decision of the Constitutional Council of France at the European Court of Human Rights. According to the decision, the bill criminalizing the denial of genocides has been recognized as unconstitutional.
This is what French-Armenian lawyer Rafael Galfaian told "A1+".
According to Kalfaian, this decision of the Constitutional Council annulled the French Senate's bill adopted on January 23, meaning that the procedure for the adoption of a similar law has to start all the way from the National Assembly once again.
Galfaian says interested lawyers will study the Council's decision until then.
"If we find that it is not well substantiated, then we will appeal to the European Court of Human Rights," said Galfaian.
The lawyer says based on current data, the Constitutional Council has corroborated its decision with the argument that the bill infringes upon the right to free expression.
"We are surprised because during the debates over the bill, it was proved several times that the bill didn't cause any problems with freedom of speech. The European Court of Human Rights already has several precedents of positive rulings in relation to this," said Rafael Galfaian in closing.
