CC denies Ombudsman's appeal

The Constitutional Court has ruled that Article 1087.1 of the RA Civil Code is compatible with the Constitution. According to CC President Gagik Harutyunyan, when announcing verdicts of financial compensation against presses, courts simply have to take into account the possibility of the given press. In addition, according to the CC President, that verdict should not be aimed at making the press declare bankruptcy. Today's verdict was 37 pages long.

We remind that RA Human Rights Defender Karen Andreasyan today appealed the compatibility of Article 1087.1 of the RA Civil Code with three articles of the Constitution at the Constitutional Court today.

The Human Rights Defender finds that the amendments made in the RA Civil Code in 2010 (Article 1087.1), which had been declared to decriminalize the concepts of "Slander" and "Offense have turned into an instrument for impeding the application of the constitutional norms of freedom of speech, as well as seeking, receiving and disseminating information in practice.
