CC satisfies A1+’s claim
The Constitutional Court of Armenia today found an act applied by the Cassation Court against A1+ Company as anti-constitutional.
Meltex Ltd (founder of A1+ Company) was disputing the constitutionality of execution of CC and ECHR decisions.
"We are appealing the 2004 decision of the Cassation Court which failed to fulfill the ECHR decision concerning A1+,"the company's legal representative Artak Zeynalyan said in the Constitutional Court.
"The European Court of Human Rights earlier satisfied A1+'s claim against the National Commission on Television and Radio (NCTR). The ECHR ruled that the state regulator had roughly breached Article 10 of the European Convention on Human Rights and failed to provide equal footing for A1+ TV Company. The breach was not registered by Armenian courts. Therefore the act should be invalidated," said Zeynalyan.
After the CC decision is put into effect, the Armenian National Assembly shall make amendments to the Code of Civil Procedure and eliminate the anti-constitutional act applied against A1+ in 2004.
After that, we shall again appeal to the Cassation Court with a demand to quash its decision against A1+. The Cassation Court can also remit the case to the Administrative Court for retrial," said Zeynalyan.
