Will Tigran Postanjyan be released?
"Heritage" MP Zaruhi Postanjyan presented a communiqué regarding the crime.
"On 23 May 2011, the RA National Assembly adopted the RA law "On Changes in and Additions to the RA Criminal Code", which went into effect on 25 May 2011. According to Article 37 of the law, Point 4, Part 3 of Article 311.1 of the RA Criminal Code is no longer in effect. Tigran Postanjyan, who has been on a hunger strike for 16 days, has been charged under that point that is no longer in effect. With that said, today marks the third day that Tigran Postanjyan is illegally in prison under the charge that is not foreseen by the RA Criminal Code.
Judge of the Arabkir and Kanaker-Zeytun districts' general jurisdiction court of Yerevan Artur Mkrtchyan was supposed to terminate the criminal persecution against Tigran Postanjyan and take a decision on releasing him as soon as possible.
This morning at 9 a.m. Tigran Postanjyan's attorney Hayk Alumyan presented a petition to the judge with the demand to stop the criminal persecution and take a decision on his immediate release, but the court has not taken a decision yet.
By not ending the criminal persecution and taking a decision on his immediate release, Judge of the Arabkir and Kanaker-Zeytun districts' general jurisdiction court Artur Mkrtchyan is committing an act foreseen under Article 133 of the RA Criminal Code, that is, "Illegal Deprivation of Liberty".
In addition to the demands for his hunger strike, starting May 11, Tigran Postanjyan also added the demand against the violation of the law.
Accepting the above mentioned as a basis, I demand that measures be taken to release Tigran Postanjyan and start a criminal persecution against Judge of the Arabkir and Kanaker-Zeytun districts' general jurisdiction court Artur Mkrtchyan for illegally depriving a person of his liberty," as stated in the communiqué.
