“The CC hasn’t exercised the powers granted by the Constitution” (video)
The CC hasn’t exercised the powers granted by the Constitution and hasn’t tried to raise the issue of legal certainty to maximum extent. The representative of “I am against”(Dem.am) initiative came to this conclusion through the CC decision, by which the Supreme Court didn’t consider it to be problematic that the NA had adopted the amendments in the law on “Funded pensions” at the extraordinary session without public and committee discussions. On July 6 by written procedure the CC examined the application presented by the NA 33 lawmakers. The application questioned a number of provisions of the law, the violations during the lawmaking. The CC considered some provisions to be corresponding to the Constitution, the others- no. HHK lawmaker considers the CC decision to be objective. He thinks perhaps a large-scale discussion should have been held over the amendments in the law, but we must take into account that they already had a long history and the lawmakers were aware of the issue.
