Ombudsman says government is inactive

For years, nearly 800 citizens of Armenia haven't been receiving their compensations for damages caused to their health during labor.

Nearly 100 of them are former civil aviation employees that had a meeting with the RA Ombudsman today. After its liquidation in 2003, the Armenian Airlines didn't leave a successor and has been in the process of bankruptcy to this day.

According to one of the Government's resolutions adopted in 1992, in the case of a legal person's liquidation, the government takes on its responsibilities. In 2004, according to another resolution of the Government, this provision was repealed, but the issue related to the compensation for people who have become disabled or have died during labor remained unsolved.

Deputy Ombudsman Genya Petrosyan indicates two versions for solving the issue.

"If the liquidated legal person doesn't have a successor, the government has to take on its responsibilities by providing compensation from the state budget or it has to create a social security system that will ensure the rights of the corresponding persons," the Deputy Ombudsman mentioned.

She underlined that the government has also assumed the obligation of creating a workers' rights protection system in front of the international community by signing the "Revised European Social Charter" and "Convention on Workers Compensation in case of Accidents during Production" of the International Labor Organization".

According to her, the government hasn't created a social security system and hasn't paid the compensations for damage caused to people's lives and health.

"There is certain lack of activity on the part of the government," Genya Petrosyan said.

The Deputy Ombudsman says people also can't restore their violated rights in court.

"The sphere is not regulated by legislation, meaning there is no violation of the law either," Petrosyan told "A1+".

Ombudsman Andreasyan promised the civil aviation veterans that he would remind the Government about them for probably the last time and informed that the Human Rights Defender's Office was currently working on the package for a structural solution to the issue.
