Bill of indictment confirmed
The RA Special Investigation Service has completed the preliminary investigation of the criminal case on abuse and exceeding of official authority by the policemen of the RA Police, Arabkir Division Investigation Department. The prosecutor supervising the pre-trial investigation of the criminal case has confirmed the bill of indictment.
During the preliminary investigation it has been revealed and confirmed that in August 2008 D. Atoyan was appointed as a policeman of the RA Police, Arabkir Division Investigation Department whose supervisor was appointed the senior policeman of the same department H. Simonyan.
On the order of the head of the RA Police, Arabkir Division Investigation Department the preparation of the materials on the case of damage with the use of a knife to the health of the security workers of the "Pioneer" night club on November 25, 2008 was tasked to D. Atoyan.
However, D. Atoyan under the assignment of his supervisor H. Simonyan committed several forgeries and willfully broke the norms of the RA Criminal Procedure Code. As a result the knife that is the tool of the crime was hidden and the crime was qualified as a battery and then the decision including false data to refuse the launching of the criminal case was presented to the confirmation of the head of the division.
On the obtained data D. Atoyan has been charged according to the RA Criminal Code Article 308, part 1 and H. Simonyan Article 309, part 1.
The criminal case has been sent to the Court of First Instance of Arabkir and Kanaker-Zeytun administrative districts for the detailed examination.
D. Atonyan's decision to refuse the launching of the criminal case has been removed by the RA General Prosecutor. A criminal case has been initiated according to the RA Criminal Code Article 258, part 4 (hooliganism committed with a weapon or another item used as a weapon). On the data obtained during the preliminary investigation carried out in the Special Investigation Service, it has been decided to involve E. Petrosyan as defendant for committing hooliganism with a knife used as a weapon, arrest has been chosen as a pretrial measure and search has been declared against him.
E. Petrosyan's part has been separated from the criminal case and sent to the RA Police to carry out the preliminary investigation.
