DID THE PROSECUTOR GENERAL GIVE CONSENT? /VIDEO/
Support A1+!Evidence continued to be released today for the case against former Deputy Prosecutor General Gagik Jhangiryan, who is charged with violence against a state official. Defendants were proving that the witnesses had provided false testimonies after the release of each newspaper.
Before that Gagik Jhangiryan made a statement:
“The 4th section of article 44 of the RA law on “Prosecution” prohibits the arrest of a prosecutor without the consent of the Prosecutor General, except in cases of arrest based on the judicial act. In my case, it is clear that there is no judicial act and couldn’t have been, not to mention the illegal arrest and the lack of legal bases. The only thing left was the Prosecutor General to agree with arresting me. There is no such document in the case that the prosecutor has given his consent beforehand,” said Gagik Jhangiryan.
After this, Jhangiryan stated that if we accept the president’s statement when he said that “the illegal order is legal even if it is conditional”, it can go into effect only a day after handing the copy of the order; however, he has not received such an order to date.
“Who arrested Jhangiryan the Deputy Prosecutor General? Who pressed the charge and appealed to court for the intermediation? It was the average investigator of the police adjunct to the RA government, but never the Prosecutor General. Thus, not only were Jhangiryan’s rights and freedoms violated, but also all of the legislative guarantees for legal defense of Jhangiryan as prosecutor,” claims Jhangiryan.
He then turned to the accuser and asked whether the violations of material and judicial norms were not an undisputed reason to immediately end the criminal persecution and quash the criminal case.
During the release of the facts, defendants pinpointed all of the illegal acts that were present in the volume of the case. For example, the defendants asked why they had decided to put the assets of Gagik Jhangiryan’s brother and son under house arrest. When they spoke about the expert’s 1.5 page conclusion on Vardan Jhangiryan, it turned out that there was not one word from that conclusion in the medical test results. In fact, according to one of the documents in the case, Vardan Jhangiryan’s wasn’t healthy and he needed long-term healthcare, but instead of that, he was kept in the cell.
The next trial will be held on December 4 at 1 p.m.
