REPUBLIC OF ARMENIA LOSES IN EUROPEAN COURT AGAIN
Support A1+!The European Court of Human Rights reached a verdict today according to which the three citizens of Armenia Lavrent Kirakosyan, Arman Kirakosyan and Myasnik Tadevosyan have been subject to inhuman and degrading treatment, have had their right to a fair trial violated and an unfeasible appeal has been registered.
Armenian residents of Lavrent Kirakosyan and Arman Mkhitaryan from Karakert, as well as Myasnik Tadevosyan from Mrgashat were arrested for a 10-day detention in connection with their participation in the events of April 2004 that followed the 2003 presidential elections.
In March 2003 the first two applicants were visited at home by police officers in connection with their participation in protest rallies about the presidential elections; following an altercation, they were arrested and taken to their local police station. Mr Tadevosyan was also arrested at home in May 2004 on account of an altercation with the police who had stopped his car for a control.
The citizens have complained about the conditions of their detention, the unfairness of the proceedings against them and the fact that they did not have a clear and accessible right to appeal.
Member of the attorney group of the citizens in the European Court Ara Ghazaryan told “A1+” that with the decision of the Court, the RA Government had to concede 7,500 euros to each of which 4,500 had to be a moral compensation and the rest for proceedings.
Member of the attorney group Tigran Ter-Yesayan recalled that there are still appeals in the European Court in connection with the events of 2003 and 2004. He believes that today’s verdict may become a precedent for other appeals.
