Support A1+!Will the Armenian juridical system become independent after the constitutional reform is carried out? The coalition forces are optimistic on the issue. They consider that the constitutional amendments will create all the preconditions for the independence of the juridical system.
Head of the RPA Galust Sahakyan expects rather serious progress. “Each member of the Justice Council has equal rights while the chairman of the Court of Cassation, who presides over the sittings, possesses the right of consultative vote. We have done a great deal of work and are expecting the conclusion of the Venice Commission”, he says.
Galust Sahakyan considers that before the second reading they will manage to eliminate al the faults. He thinks it is important that though the President appoints the chairmen of the courts, the appointments are based on the decision of the Justice Council.
ARFD faction member Vostanik Marukhyan reminded that as result of 2-day consultations with the Venice Commission the latter’s proposals met no objections. “We have introduced the necessary changes”, he notes. Vostanik Marukhyan is convinced that the constitutional reform will promote the independence of the juridical system.
As for the order of the appointments of court chairs by the President, Marukhyan thinks it is normal, since all these candidates will first of be approved by Justice Council. “There is a list and the appointments are made in accordance with this list”, he notes. Nevertheless, with all their optimism Galust Sahakyan and Vostanik Marukhyan consider that the independent juridical system should be provided not only by the constitutional clauses but also by the structures engaged in administering justice with their readiness to perform all the necessary functions and reform the system.
