WHEN CONTROLLABILITY FROM INSIDE IS DOMINATING

Ara Sahakyan, ex-member of the Armenian Pan-National Movement and member of the non-governmental organization “Armat” answered the questions of “Ayb-Fe”.

- While choosing the governing system of the Republic of Armenia why was the French Constitution and not, say, the British one chosen as prototype?

- The choice of the Presidential system in the first phase of development of the state was conditioned by the desire to secure internal controllability. I announce that there have been no intentions to take the experience of a country. We were not under pressure from abroad, and in contrast to today's authorities, from the Venice Commission. All the post-Soviet republics faced the problem of forming their sovereignty, and the dominant problem was to enhance their state.

- What do you think, is the controllability actual today or could we change the RA Governing system instead of Constitutional reforms?

- The materials which we have hint that the enhancing of the power of the Prime Minister can cause a serious problem within the executive power in Armenia. The Prime Minister who is independent of the President can be the source of constant destabilization.

- But doesn't the President have super authorizations by the acting Constitution?

- From the point of view of Constitutional right, the Constitution we adopted is a semi-presidential system. Another problem is that Robert Kocharyan is in the habit of violating the Constitution. He started from the violation of the clause about 10 years of citizenship and residence putting forward his candidacy and becoming the RA President. This can be done under any Constitution.
