OMBUDSMAN’S NATIONAL FEATURES
Support A1+!In the opinion of the parliamentary oppositional forces the Ombudsman should be elected by the National Assembly. “The institute of ombudsman was formed by the Armenian leadership for exercising a recurrent imitative policy. The Ombudsman only imitates a working atmosphere. Actually we do not have a human rights defender”, Secretary of National Unity faction Alexan Karapentyan said.
In the deputy’s opinion, the order of appointing the Ombudsman is very important for his independent activities. Here one principle functions: the person, who appoints the Ombudsman, dictates his activities. It can be proved by the decision of the Constitutional Court, according to which the Ombudsman’s authority was limited. “Even the acting Constitution provides for the appointment of the Ombudsman by the National Assembly. However it does not happen”, Victor Dallakyan says adding that presently the most defenseless person in Armenia is the human rights defender. Alexan Karapetyan shares his opinion.
“We can say we have a double constitution. Everything depends on the President only. However of a person is a democrat and wants to work for his people it is possible to achieve human rights protection. Every law has its shortcomings. However the authorities wish to introduce plenty of limitations to the law while people wish the Ombudsman to have greater authority. Larisa Alaverdyan’s first report showed that her activities are not seriously treated. All this is the result of limited authority, deputies consider. Of course the human rights defender must not be empowered to punish but his should press for punishment for the person, who has committed a violation.
