JURIDICAL SYSTEM TO BE LIQUIDATED
Support A1+!Today members of Democracy public organization presented in detail the changes to the Election Code, which in their opinion are anti-constitutional and regressive as compared to the acting code and do not secure fair and free elections
The organization prepared the conclusion of experts regarding the Election Code and is ready to present it to all the interested parties, including the OSCE Bureau on Democratic Institutes and Human Rights and the Venice Commission. The organizations members hope that when compiling the final conclusion will take into account the opinions on the changes to the Election Code.
Noting the contradiction between Article 98 of the Constitution and the changes to be inserted in the Election Code Vardan Poghosyan said, “A judge cannot be an administrative body - member of the commission and the person to draw the final conclusion on the decisions made by himself”.
Hrayr Tovmasyan reminded, “There will be 40 election commission and 2 persons, who will appoint members out of judges. It means that 82 judges will be engaged in the election commissions. The number of judges presently makes 161, 21 of them are economic judges and do not serve on the common juridical system. Thus 80% of judges will be engaged in the election commissions.
It turns out that during the elections the juridical system will be liquidated. To note, this circumstance inspired chairman of the Helsinki Committee in Armenia Avetik Ishkhanyan, who considers that such juridical system should be liquidated anyway.
