«FREEDOM TO THE OMBUDSMAN»
Support A1+!Anjey Malanovski, head of the Constitutional and International Rights Department, was present at the discussion of the correspondence of the RA Constitution to the article 7 part 1 second paragraph of the Law on the Defender of Human Rights which did not take place.
The latter considered it his duty to express his opinion about the Ombudsman Institute. He told the journalists, «In many countries of the world the Ombudsman Institute is a very strong structure and has large authorizations. It can make speeches in courts and appeal court decisions».
According to Anjey Malanovski, independence is an inner problem, «If somebody says that the Ombudsman hinders the court independence, it is the same as saying that the court must be independent from laws. With the same logics it can be said that the attorney, the prosecutor and others affect the independence of the court. The Ombudsman does not act in favor of a side but only contributes to fairness. »
Speaking about the experience of his country Mr. Malanovski noted that in Poland The Ombudsman not only freely criticizes and appeals court decisions, but also criticizes and comments on Constitutional Court decisions and conclusions, and no one ever blames him for it.
