EVERYONE SHOULD HAVE RIGHT TO APPEAL TO CC
Support A1+!In the opinion of international specialists, the Constitutional Court of the Republic of Armenia deals with the solution of moot questions. It is caused not by the scope of its authority but the limited circle of those, who appeal to the CC.
Presently the only the President, one third of the total number of deputies, presidential contenders as well as the deputy in case of an argument connected with the elections exercise the right to appeal to the CC. The government can appeal to the CC in accord with the Article 59 of the Constitution when the President is seriously ill, for example. Experts offer to fix in the Constitution a clause, which would allow any person let it be a citizen, foreigner or a person without citizenship appeal to the CC with an issue of concern. Should all the citizens have the right to appeal to the Constitutional Court? This is the question we asked 100 citizens.
55% of the respondents supported the idea of fixing such a clause. In their opinion it would contribute to the protection of human rights.
“The issues not solved in the three degrees of jurisdiction are likely to be solved in favor of the citizen”, one of the respondents said with hope. 30% of those surveyed found difficulty in answering. 15% spoke out against such an initiative bringing forward the following reasoning: there is no need of changing the acting Constitution, all the same it will not improve the situation with human rights in the republic.
