CONSTITUTIONAL COURT POSSESSES OVERCONSTITUTIONAL AUTHORITY
Support A1+!«It's a pity that the authors of the coalition constitution draft are not known and it is incomprehensible who and why has compiled this draft», chairman of the Armenian Center of Assistance to Culture and Strategy Simon Kamsarakan told our reporter. In his words the very idea of the Constitutional Court (CC) is distorted as with an acting constitution the National Assembly or the government can by mistake adopt an anti-constitutional law. This issue should be viewed by the CC but as a matter of fact it does not take place as the CC does not possess such an authority.
There is another problem as well: actually of people adopted the Constitution and the President who is to defend the constitutional order commits treason the citizens have the right to raise this issue. If the NA, government and the President play the same game the CC may become a very dangerous body», Simon Kamsarakan says.
Moreover, according to the coalition constitutional draft the CC is empowered with authority which can cause serious consequences down to the collapse of the state. The matter concerns the mechanism of territorial administration.
As for the lifelong authority of the CC Chairman, Simon Kamsarakan considers that «in today's reality it cannot be tolerated, especially in small counties. Lifelong authority can be offered in case if a real mechanism of preventing crimes is acting. Nowadays no singe ruling body bear responsibility for the crime committed or not committed crimes.
